Announcement from the Ministry of Labor: Notice of Draft Amendment to Article 2 of the "Labor Standards Act Enforcement Rules"

The substantive content of this law has not changed, but the name of the "Gender Equality Work Law" has been changed, so it was revised accordingly. The following is the content of Article 2 of the Implementation Rules of the Labor Standards Law. There are seven items that are not included in the average wage.

1. The day when the calculation event occurs.
2. Those who are still undergoing medical treatment due to occupational disasters.
3. Those whose wages are reduced by half in accordance with Paragraph 2 of Article 50 of this Law.
4. The employer is unable to continue its business due to natural disasters, accidents or other force majeure, causing the employees to be unable to work.
5. Those who take ordinary sickness leave in accordance with the labor leave regulations.
6. Those who take menstrual leave, maternity leave, family care leave or maternity leave in accordance with the Gender Equality at Work Act, resulting in a reduction in wages.
7. Those who remain employed without pay.
